§ 3. Applications

  • A. Application Forms. Applications for consideration of a petition to or approval of the Commission shall be made upon forms approved by the Commission and furnished by the Secretary in the manner deemed appropriate by the Secretary and in accordance with applicable rules and regulations. All applications shall be timely filed with the Secretary. An applicant shall provide all information requested on the form and shall provide any additional information requested in writing by the Chair or Secretary which is deemed necessary for consideration by the Commission. If the fee owner of a property does not sign an application, then prior to processing the application, the Secretary shall require a letter signed by the fee owner and acknowledged by a notary public authorizing the applicant to make an application to the Commission on the fee owner's behalf.

    B. Withdrawal. An applicant may make a request for withdrawal of an application to the Secretary at any time prior to the Commission voting on the merits of the application; provided, however, if a motion is pending to determine the outcome of the application, such motion shall be withdrawn by the moving Commission member and upon a second by another Commission member before an application may be withdrawn.

    C. Postponement. An applicant may make a request for postponement of the consideration of an item in writing to the Secretary at least twenty-four (24) hours in advance of the scheduled meeting. The Secretary shall not be required to consider more than two (2) requests for postponement of an item.
