§ 5. Contracts

  • The city manager shall be responsible for the execution of all contracts for the departments and offices under the control of the city manager. The city manager shall administer all necessary contract compliance procedures of the City, relating to federal and state prevailing wage laws (as currently codified in the Davis Bacon Act 40 U.S.C. §276a, and ORC Chapter 4115: Wages And Hours on Public Works); Equal Employment Opportunity Program (Ordained by Ord. No. 331-1999); Small Business Enterprise Program (Ordained by Ord. No. 335-1999); Living Wage Program (Ordained by Ord. No. 362-2002). In instances where the city manager is not required by ordinance to sign or execute a contract, form or document, but does so under the general executive and administrative powers conferred upon the city manager by law, such signing or execution of the contracts, forms or documents may, in the discretion of the city manager, be delegated to such city officials, or agent of the city, as is designated by administrative regulation. In instances where the city manager is required by ordinance to sign or execute a contract, form or document, the city manager may delegate the signature or execution to an assistant city manager.

    Execution of contracts processed by the city purchasing agent of the division of purchasing of the department of finance may, in the discretion of the city manager, be delegated to the purchasing agent after submission of the board of control recommendation by the purchasing agent in its approval by the city manager. The city manager may also delegate to the purchasing agent the duty and authority of signing contracts for combined purchases under § 25 of Article IX of the Administrative Code.
